Legal Question in Criminal Law in New Jersey

arrested or not

If you are called on the phone by the prosecuters office and asked to go there to answer questions which i did,and they tell u point blank that u r NOT UNDER ARREST,can a newspaper release a story claiming that u were arrested?

If you are 100% sure that you were not arrested, even technically so, then the newspaper should not have printed that you were. What recourse you have against the newspaper, I don't know.

If you were really not under arrest, and the newspaper printed that you were arrested, that would clearly be false. Whether you could take action based on that would depend on exactly what they printed and what the facts were. Call me if you would like to discuss it further at 877*688*3879.
