Your nephew will have to appear in the County Courthouse where the arrest occurred. He should be represented by an attorney and hopefully some type of plea bargain can take place. If you wish to discuss this matter further you or the child's parents can call me at 732-286-2170.

Both of the charges, possession of marijuana and being under the influence of marijuana, will be heard at the superior court and not the local municipal court - they should be getting a court notice soon. This is because of the age of your nephew. Since he is a minor the court will require that he have a lawyer. Before the first court date on this case your nephew's parents should hire a lawyer. This is something that is advisable anyway - it wouldn't be right for a young person to have to face a judge and prosecutor by himself without a lawyer to represent him. He is facing time in juvenile detention as a result of the charges against him, after all. I am an attorney who has a lot of expereience handling juvenile criminal matters in New Jersey.
