Legal Question in Criminal Law in New Jersey

Juvenile Offense

My 17 yr old son went to a privately owned abandoned poolhouse with his 2 friends. They found some sex toys scattered all over and in boxes. His friend took some pictures of my son playing with these toys not showing his face, then they left without taking anything. Few days later his 2 friends decided to go back to steal some sex toys but my son didn't want to be part of their plan. So he told them he's going home, but since he had a car his friends requested if he could drop them off. He dropped them off at the restaurant's parking lot next to the poohouse and left. Eventually more kids from another school started stealing these toys in duffel bags and later the school alerted the police. Now the police wants to hear my son's side of the story and wants to question him. My questions are: 1. should we go without a lawyer 2. what offense could my son be charged? 3 if the owners of the property/sex toys won't press charges, will my son still be charged? 4 what do we tell the police if we don't want to go down for questioning?

Since your son is a juvenile he should not talk to the police without a lawyer present. At the very least he can be charged with trespassing, and if he took anything from the structure then he can be charged with burglary. Do your son a big favor. Call an attorney now and I mean right now. You can call me at 732/247/3340 to discuss the case. Having him talk without an attorney would likely be a HUGE mistake!!

Your son needs to speak with an attorney as he is probably being viewed as aiding and abetting his "friends" in a burglary. These are serious charges - if they want his version an attorney can give it without incrimination.
