Legal Question in Criminal Law in New Jersey

public defender vs. criminal lawyer

I am 19 years old with a clean record, never been arrested, involved in any crimes so on. I dont use marijuana, and a test would tell I am clean. I was arrested for fourth degree intent to distribute marijuana, and possession of marijuana under 50 grams, a disorderly persons offense. I am a full time college student, and I have a job which I have worked at for over 1 year. What do you think a criminal laywer could do for me, verses what a public defender could do for me in my situation?

Re: public defender vs. criminal lawyer

Its not so much a matter of "what one verus the other could do for you." First, you don't just get a public defender - if you can afford to consider hiring a private attorney then you may well not qualify for a public defender who is provided as counsel for indigent defendants. Secondly, there are both good and bad private attorneys and public defenders, so one can't just say that one or the other is better. The one area, however, where a difference may come up is time and attention to your case. A public defender may not be able to give your case the full attention it deserves or investigate the case much because of limited time/funds. If you wish to mount a more aggressive defense that will take a good deal of lawyer time, then a private attorney is the way to go if you can pay the fees.

I am a private attorney that handles these types of cases. If you are in South Jersey and would like to talk to me further about possibly representing you in this matter then please give me a call.

Thanks,
