Legal Question in Criminal Law in New Jersey

What is Best Way to Resolve WAs?

Jim has mental illness. Not violent. WA exists charging he issued a bad check for $600 in order to open a bank account. Also has WA for urinating in public. Also has 10 summonses for minor charges. He is not certain he issued check-this is supported by his mental history and circumstances of offense.

Strategy to stay out of jail:

* One morning, Jim and I appear at court to speak with prosecutor to persuade him to recommend ROR.

* Next morning, Jim turns himself in, bail hearing held that day, and judge orders ROR.

1. The Bail Hearing. Is it reasonable to expect the bail hearing to be held on the same day he turns himself in?

2. Can I advocate tho not a lawyer?

3. Can we speak with PDO before bail hearing?

4. Where can Jim get free legal advice?

5. Where can Jim find a pro bono lawyer?

6. If he goes to jail after bail hearing: is it possible that bail could be reduced over time (like two weeks) so that it becomes low enough where he can meet it or even perhaps have the bail eliminated?

7. How likely is it to happen that Jim is granted ROR for the criminal offense, immediately followed by other court not executing its warrant for its very minor offense?

The Court will not allow you to advocate on his behalf. Jim could apply for a public defender, call your regions branch. If he does not qualify for a public defender or if he does not want a public defender he really should hare an experienced attorney because of the number of charges pending against him.

Your friend appears to be in so much trouble that he badly needs the services of an experienced criminal lawyer who will have to be paid a reasonable fee for handling so many criminal charges.
