What's my sentence?

What is the best case secnerio for getting caught with possesion and intent to distrubute crack cocaine? What is the easiest and worse sentence they can give me?

Best case scenerio: You are accepted to PreTrial Intervention ("PTI") and thereby placed on probation with no trial and with no guilty plea. After a period of time, typically a year, if you have no further arrests, the charge is dismissed and you have no record of conviction.

Worst case scenerio: This depends on the amount of crack you allegedly intended to distribute. If the amount exceeds five ounces, it is a first degree crime for which you could be sentenced to twenty years in prison and be required to serve ten years before becoming eligible for parole. You could also be fined up to $500,000.00.

The severity of possession(with intent to distribute)

of crack cocaine in NJ depends upon the quantity of

the drug possessed, and the location of the offense.

Possession of five ounces or more is a crime of the first

degree. One-half to five ounces is second degree,

and up to 1/2 ounce is third degree. Penalties vary

considerably, depending on the circumstances, so
