Statue of limations?

To make a long story short. My husband had a drug prob.& as a result to that he did shoplift etc... He has done time in jail b4 that and drug possesion. He has since celeaned up and we had moved far away. He has his life back in order and can prove that by a counsler. But he has open charges for a shoplifting under 200 and another in for possesion of herino . But this has been about 4 1/2 yrs ago. Can we move home and have this dropped? He herd there was like 5 yrs then they had to drop? Please this is very important we want to move back home and start our family.

The statute of limitations only applies if no charges have been brought within a certain time period. If there are charges outstanding against your husband and he did not go to court on them, then he is a fugitive and he can be arrested on them at any time. Once a charge is made the statute of limitations stops running. A fugitive has no right to a speedy trial either. The only advantage is that the state may have proof problems because witnesses sometimes move away or die.

It is easier to deal with old charges where the defendant arranges to surrender voluntarily. Surrendering usually means a lower bail than being arrested on a warrant because it reflects a decision to deal with the charges.
