plagiarism and the discrimination behind it

In 2002, I filed a discrimination complaint against my boss. Recently, my work was plagiarized by someone who works in the same company as me. I confronted my boss, who co-authored the plagiaristic paper, about the situation and he told me there was nothing he can do about it. My boss was fully aware of the plagiarism involved when he approved the paper for publication. I believe his actions are based off of discrimination against me, especially after my complaint in 2002. Do I have a case?

First off, everything you do for your job is probably work for hire, so I doubt you'd have a case for discrimination.

HOWEVER, that doesn't mean you shouldn't document this complaint, with PROOF of the plagarism and see what happens.

If you filed an EEOC claim (which you should have if you filed an official discrimination claim), send them a copy of the new documented claim and how it is tied to the prior discrimination.
