DUI Sentencing NJ

I received a DUI 06/2006, I have not yet been sentenced I just received a court notice in the mail stating that I will be sentenced on 4/23/2008 my test was a .12 what are the penalties and do I need another attorney?

Apparently, you have pled guilty to dwi and face sentencing.Whether you should have an attorney go to court with you depends on a number of factors, such as whether this is first, second or third dwi.

If this is your first offense and your reading is only a .12, you don't have to show much to get this down to a 0.9. I strongly suggest you speak to a new attorney about taking back your plea and fighting the case to at least get the suspension down.

The attorney who represented you should have been advised of your court date and according to court directives, is expected to appear with you. I would give him/her a call. I do not recommend that you simply appear and surrender your license. While the Supreme Court has indicated that the alcotest machine is scientifically reliable, several factors must be reviewed before the your readings can be accepted by the court. Please speak with an attorney.
