Legal Question in DUI Law in New Jersey

dwi and alcotest

I blew a 0.15 on an alcotest, but the machine hadn't been certified in over 8 months, and the officer failed to sign the AIR. My attorney (recommended by a friend) says that he has nothing to work with and wants me to just plead guilty....I was hoping he could fight to get it down to a 3 month suspension, is it at all possible. It's a first offense and I had a completely clean driving record for over 23 years prior to my horrible judgement this one night.

Re: dwi and alcotest

I see no reason to plea out. Might be time to switch attorneys. I would need more information. Feel free to call or email me with the rest of the story.

Re: dwi and alcotest

The issue most definitely should be presented to try and exclude the Alcotest readings. The file must be carefully combed through against the Chun ruling to glean other possible issues.
