Legal Question in DUI Law in New Jersey

DWI and suspended license

Ok I had a DWI Nov 07. they finally sentenced me to 7 mo suspended and various fines in nov 08. my parents drive my car since and i needed to register it but since i have no license i called the nj dmv to find out how to go about registering the vehicle. turns out the dmv has no record of a dwi or a suspended license. i had my buddy whose a cop run my license # and it came back valid. what are the laws governing me going to dmv to get a new license and start driving again? this wasnt my fault, i had to relinquish my license nov 08 when i was at court so its the courts problem/fault. somewhere between them and the nj dmv my work got lost i guess? anyway im just curious what could happen? technically my license isnt suspended like it should be so is it still somehow against the law if i drive again?

Re: DWI and suspended license

You are losing your mind. YOU WERE TOLD IN COURT THAT YOUR LICENSE IS SUSPENDED. Driving while suspended for dwi is an additional driving suspension of a year and a half.

Re: DWI and suspended license

You should contact the court where your license was suspended, explain to them what you wrote in this e-mail, and have them fix this problem. I would not advise you to just start driving becuase you know that your license really is suspended, despite the mix-up by the court.

Re: DWI and suspended license

You really should sort this out with the Court that took your license originally. It may require getting a transcript of the original hearing. Talk with the Court Administrator in the town where you lost your license.

Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other facts that would change my opinion. And, no one can rely on the opinion of an attorney who has not been retained. Before you do anything, you should consult with a Municipal Court attorney. I would be happy to discuss this matter with you if you would call me. Mention Law Guru and your first one hour consultation is free. Good luck! Rob Gleaner

Re: DWI and suspended license

I have had clients that have had the same experience. You will eventually have to go back to court to straighten this out and you want to make sure that when you do, the judge makes the sentence retroactive to the original sentencing date. I would be happy to speak with you.
