Legal Question in DUI Law in New Jersey

I am facing a aggravated assult charge in connection with a DUI accdent in NJ. I have been informed that I will be indicted. I have retained an attorney. My question is: is jailtime mandatory for a conviction? I am the sole caregiver of my elderly, invalid spouse. He cannot take care of himself on his own. Would this factor be taken into consideration in my sentencing. Is there any lenieancy involved?
