Legal Question in DUI Law in New Jersey

Hi,

My brother-in-law has been ticketed for under age gambling at a Trump Taj Mahal casino in Atlantic City. He is 19 years and was caught by casino security while playing at slot machine within 10 minutes. He is summoned to appear in Municipal Court of Atlantic City on 04/05/2010.

What are the changes that he does not loose his DL? He is willing to take community service as an alternative punishment.

The Casino Control law dealing with underage gambling specifically states that the person convicted of underage gambling will lose his driver's license for six months upon conviction. It does not provide for any community service option in lieu of a license suspension. I would need more information about the full details of this case before I could tell you what the possibility of winning the case at trial. I go to the Atlantic City Municipal Court frequently (I was just in court there two days ago), and I know that they are not allowed to plea bargain underage gambling cases. The only chance your brother in law may have is if he takes the case to trial and wins. Please call me to discuss this case in more detail.
