Legal Question in DUI Law in New Jersey

Proof

Regardless of whether or not the method of breath testing is accurate or not, how can they every prove whether or not the results that are filed actually match the person who has been arrested? You are not asked to sign anything verifying that you took the test and it is in fact your results. In my case I wasn't even read the full document prior to blowing. The officer simply told me, ''take the test or they'll find you guilty anyway.'' Anyone could have blown in the machine and they could say that it was my results.

This is a good question. The only answer that I know how to give is that society is built upon trust and the police would have no incentive to try and convict you personally (unless you can somehow prove they had some kind of longstanding grudge against you). The easy answer to your question is to just get an attorney and let him or her defend you. Your not going anywhere with this argument. The police will testify that they handled all the documents, filled them out, and maintained them. That's all they need to do. Furthermore, anyone else blowing into the machine would also have to be drunk so I doubt there are too many of these people just hanging around the police station.

Finally, lets say the results get thrown out? Case over right? No. You can still get convicted on your symptoms.

You have two choices. Go to court by yourself and take your lumps or hire a good attorney which requires paying some decent money to him or her and fight it with everything you got.
