Legal Question in Family Law in New Jersey

401k & cash value in insurance account

My spouse has a substantial amount of money in a 401K plan and a huge contributory cash amount in a group life insurance plan.

1. Am I entitled to 1/2 of both of the above in a divorce?

2. I have copies of what the amounts are in both of the above, so can my spouse--name removed--in and take out moneys without my knowledge to reduce the amounts. Also, if my spouse does, can I bring up the fact that I have documentation of the true amounts and hold that spouse to those amounts?

You are certainly entitled to some part of it. The pecentage you are entitled to is dependant on a number opf factors, including how long you were married.

You may be ableto restrain the accounts so that he cannot transfer the money.

I strongly suggest you call me or another attorney fopr legal representation.
