Legal Question in Family Law in New Jersey

annulment

I have sufficient grounds for an annulment, but he keeps alluding the Sheriff with the papers he needs to get served with. It has been 4 years now. I have no idea where he lives now and can't afford an investigator to locate him. I tried the Internet with no luck. How can I finalize this problem?

Re: annulment

Private process servers are now authorized to serve summons and complaints in NJ. You should retain one of these companies, giving them all of the information you have to attempt to serve this guy. If you are still unsuccessful, there are ways to serve by publication upon approval by the Court. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since you have not retained an attorney in this case, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner

Re: annulment

hi -

you could file a notice of motion with the court for service by publication. if the judge grants it, then you would follow the instructions in the statute for advertising the summons, etc. it's pretty complicated - most people get a lawyer to do it for them. if you have any other questions, feel free to call me at 609 263-0089. good luck !
