Legal Question in Family Law in New Jersey

Does child have to visit when dads wife is abusive.

My daughter is 12, she does not want to go to her fathers every other weekend(in court order). Her father's wife is verbally and mentally abusive towards her. Does she have the right to not go? She is to go this Friday and said she is not going. By law, does she have to go if she is afraid. She wrote her father a letter explain her fear but he has not responded yet. Can a police officer put his hands on her and make her go with them.

Please Help.

The short answer is no, but a detailed explanation of the facts would be helpful in order to advise you further. Because of your area code, I suggest that you call my colleague, Jane Herchenroder, Esq., in Somerville, NJ, 908-231-9222. She is well aquainted with family law issues and can advise you accordingly.

Good Luck,
