Legal Question in Family Law in New Jersey

I have custody of my 7 year old son. I filed for court for his father to have temporary custody until I got a new apartment...but when the court date came around his father never showed up and I got default full custody. This all happened over a year ago and my son has been with his father while I hold legal custody. I am moving out of nj to texas in days and want to take my son with me...can I legally do this?
