Legal Question in Family Law in New Jersey

Divorce after 18 months of seperation

My girlfriend and I want to get engaged, however, she is technically still married. She has been seperated from her abusive ''husband'' for about two years. She doesnt know where he is and he makes no attempt to pay child support for their 4 year old son. How do you divorce someone who disappeared in NJ?

Re: Divorce after 18 months of seperation

Your girlfriend needs to file a divorce action. Service has to attempt to serve him at his last known address, but once you make reasonable attempts to locate him, you can serve by publication. There are some other options as well.

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.
