Father's Rights

Does a father, paying alimony and child support, have the legal right to know where and when his child's birthday party is going to be held and to attend, without any legal consequences against him from his ex-wife?

My son's ex-wife refused to tell him where and when his child's birthday party was and if he did find out and attended, she threatened to get a restraining order against him. His child wanted him to attend and voiced this to her mother.

Would appreciate any legal advice you can offer.

My first advice is for you to stay out of your son's divorce proceedings. Divorces are hard enough on the participants without the parents of the participants interfering. Further, I would doubt that the main problem here is this isolated birthday incident. If the ex-wife was so extreme in her position that he not be there, there is more to the story. I would suggest that your son seek the advice of counsel to be sure that he is doing what is required and obtains all rights to which he is entitled. Good luck! Rob Gleaner
