Legal Question in Family Law in New Jersey

Legal Guardianshio of a Minor

Basically, my question is in the area of Guardianship of a minor, here in the state of New Jersey. The issue is, my sister, who lives in Florida, has been ill and not capable of taking care of her 16 year old daughter. So, about 2 years ago or so, she sent her to NJ to live with our brother. Things have not went well in that situation and my sister does not want her with him anymore and wants her daughter to live with me, also in NJ. My sister did not turn over legal guardianship, just wrote a letter allowing him to make her decisions regarding school. I am afraid he will fight us, if we try to do this without exploring all the legal issues first, the 16 year old is willing to come here with me, but is afraid of all the confrontations ahead, more reason to try to do this by the book.

I appreciate any and all advice you can give me.
