Legal Question in Family Law in New Jersey

I live in New Jersey and I am fighting for supervised visitation and sole custody for me. I am her mother and her father wants partial custody. But her father and a substance abuse problem and his drivers license taking away due to several DUIs and fines. What rights do I have to ask for sole custody because my daughter is only two years old?

The issues that you have described, if established in Court, may be very persuasive to a Judge to require supervised visitation and sole custody. However, it is rarely that easy to establish. When disputed, you would be required to bring proofs into Court such as his driving abstract, substance abuse reports or records, etc. Because the stakes are so high, you should seriously consider getting an attorney to represent you in such a matter.

Keep in mind that this answer is given based on the scanty information you have provided. My answer may change based on other information. Further, you cannot rely on this answer since you have not retained me as your attorney. To be sure that you have accurate information and direction, you should consult with an attorney.
