Legal Question in Family Law in New Jersey

moving away from abuse

I have 2 daughters and their father (we are not married) is very verbally abusive in front of them and he has been physically before as well. I want to move out of state, I am in NJ now. Can I legally take my children and move out of state? I just can't bare living like this anymore and can't bare the thought of my children thinking its okay for a man to treat women this way.

Re: moving away from abuse

You need a lawyer's help to decide what is best for you and your girls. There is a lot at stake. Beg, borrow, but find the money, and get a decent divorce lawyer to help you.

Hire an attorney. Go see an experienced divorce attorney located reasonably near you, and pay the attorney to review your situation carefully with you, and give you some guidance.

If you would like, give me a call; I am in northern New Jersey. I will be happy to discuss this with you; the telephone consultation will be free.

Re: moving away from abuse

If he does not consent to the move, you need to file a motion with the court. These motions can be difficult and I strongly suggest you at least speak to an attorney before doing anything.

Re: moving away from abuse

Moving away from abuse is an excellent reason to move, but you need a Court order authorizing same.

You seem to be saying that he hits you in front of the children. You should consider filing a domestic violence complaint if this is the case. You need to hire an attorney.

Call me if you like.
