Legal Question in Family Law in New Jersey

Paternity Test

18 years ago I was legally married and had a daughter. I acknowledged Her as my own and the time of the separation still took care omy responability.

A few days ago an old friend of my told me that my daughter wasn't mine. Now I am very upset and doubtful about it. I wnt to persue a paternity test, all these years I paid child support and another reason I have doubt is we broke up because she was unfaithful my question are what my chances of the Judge granting my request and also the money that I have been paing thru out the years in childsupport.

Re: Your daughter

Of course she's your daughter. Weren't you there when she woke up at night and wanted a glass of water? Weren't you there to see her school plays and to help her make her school projects? Weren't you there to comfort her when her first boyfriend broke her heart? Did you take pictures of her before her prom? How can you say she's not your daughter? Would she be any less your daughter if the test proved there is no biological link? Is the money that important to you that you want to drive a wedge in the relationship between you and your daughter. It's time to move on. If you still believe that you want to attempt to open this long closed issue (closed after 18 years of the above), then pay a family lawyer for an hour of his/her time and you can get the legal response. Then you can rely on the advice you get. Good luck to you and your daughter. Rob Gleaner

Re: Paternity Test

hi - i would forget about trying to deny paternity, at this point. there's a presumption that a child born during the marriage is "of the marriage." to spend money on a blood test now for the 3 of you seems to be a waste. you won't get the child support back anyway, even if she isn't your daughter. instead, i would work on enhancing the relationship that you and she share. if you have any other questions, feel free to call me at 609 263-0089. good luck !
