Legal Question in Family Law in New Jersey

Subpoena Creditors for Ex-husband credit account history

Ex-husband filed motion 1 year after divorce trial and submitted 3 credit cards only in his name with an substantial amount of debt. He feels that I am responsible since he opened these cards prior to separation (June 2002). The Judge gave me the obligation to proof that I am not responsible for these cards within 90 days and also gave me a court order to obtain account information from the collectors. They refuse to give me any information since I am not on the accounts. I would like to issue a subpoena. How do I go about it? Thanks.

I understand your problem, proving that charges on cards are NOT yours, not family debt. Why in the world did the Judge make you prove it is NOT, why not make him, the account holder, provide the information? The Judge may not have understood that issue.

You will have a difficult time with this problem, I suspect. Although you may have difficulty managing it, I think you really need an attorney's advice and assistance. This is NOT an issue that I can easily answer in a way that will solve your problem. You need a lawyer.
