Wife wants me to file for divorce

My wife wants me to file for divorce. I have a 17 son in his last year of high school, and would not like to put him through the trama of making this adjustment. We own the house together, but the child is from another Marriaage. I anything I would like to hold off until January to file, which I belive would take until maybe March-April to finilize. Which will minize the impact. Please help with much more than contact an attorney. Do I have to sell right away, what other options do I have. She is becoming verbally challanging, neglecting bills, basically trying to drive me to file. I'm extremely careful with conversation, any physical action, and being alone without a a recorder.

I have read what the other attorney has said. Rob has thoughtful and correct comments.

You need a lawyer. Find a divorce lawyer near you.

And you are at risk. Really at risk.

You said she is challenging you, to the point where you are careful of physical action. Do you have any idea of how damaging it would be if she has any basis at all and files a Domestic Violence action against you?

Please go see an experienced divorce lawyer. Get some advice. Worrying about when you are going to file and whether you will have to sell the house quickly is wrong. You are not seeing the huge problems you could face, even if you really are careful and do nothing wrong.

I agree with the other attorneys. An initial consultation is more than just you asking a broad question and me giving a quick answer. My consultations take at least 20 minutes and there is a lot of back and forth because there is a lot of information that I need. I also need to give you your options and discuss the pros and cons of each. Then you can tell me which direction you would like to go in.

The bottom line to your situation is that you should just get divorced now. Divorces take at least 6 months. Not to mention, this real estate market is horrible. You'll be lucky if you sell your house within 12 months. Thus, the two of you can still live in the house after you are divorced. I have several clients that have done that due to this market. Finally, the child is of such an age that I doubt the divorce will impact him much.

I find it ironic that you are asking a question of lawyers, yet you say "Please help with much more than contact an attorney". In other words, you are contacting attorneys for advice but you are indicating that the answer should not be "contact an attorney".

Unfortunately, this type of format, while good, can only do so much. Your questions require much more exploration with a full consultation with an attorney, before you can get any reasonable advice.
