Legal Question in Family Law in New Jersey

I got word that the local police were attempting to serve me with a TRO on behalf of my ex. I left on a previously planned vacation, and was never served. During my absence, the police came to my door and notified my friend that a hearing was scheduled for the following Monday, which was during my absence. They also left a voice mail on my phone, but I was out of the country and my cell did not work. The hearing was scheduled for last Monday (11/14), and I have heard nothing. Is it possible that they conducted the hearing without my notification? And, if so, if I had been found "guilty" of domestic violence, wouldn't they have had to notify me formally by this time?

You should immediately contact your local police to find out if they have a TRO or FRO for you. You could also call the Domestic Violence Unit of the county in which you live to get this information. If either has been issued, you should immediately retain an attorney to rectify the situation.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. Feel free to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. If you were not properly served with the temporary restraining order the hearing should have been adjourned until you could be served with same. If the hearing was held, you can apply to vacate the judge's decision and have a hearing. Call me, if you like.
