Legal Question in Medical Leave in New Jersey

intermitant leave

Am I eligible for intermittent leave for migraines if all of the other criteria are met?. I have been suspended for my absences and have provided medical certification that I suffer from this condition which totally incapacitates me making it impossible to go to work.

How do I apply for such a leave when I do not know when the next migraine will occur?

You are probably covered. Contact your company's HR department. If the need for leave is unforeseeable, then you can request that it be covered by the FMLA after the leave has started.
