landlord rights

i am a home owner who rents the upstairs of my home. no leases. month to month. i live in this residence.

i require a one month rent deposit up front.

present tenent moved here in july2003.only had half of the upfront money but i allowed the balance owed to be paid monthly at $50 per month till paid. this has been satisfied as of this date.

rent due on 15 of the month.

dec 2003 paid 2 wks late.

jan 15 no payment received.

feb 15 will not receive anything either.

why ? he is not working....no money

his electricity was shut off last week for non-payment. since restored.

i want to advise him that he must leave due to non-payment.

this is the first time i have had any problems with any tenant. i only rent to people who are recommended by people i trust and know personally.

1. how do i advise him to leave what should i put in the letter which i will hand deliver

2. how many days notice must i give him in the letter

3. what recourse do i have if he does not leave.

We can assist you in serving the appropriate notice to terminate your residents tenancy. We are compensated at an hourly rate which varies depending on the attorney performing the services. Our rates range from $175-$255 per hour. You are also responsible for the costs and expenses incurred in the performance of our services. These may include court filing fees, postage, photocopies, toll telephone calls, travel, and other expenditures made on your behalf. Our bills are submitted monthly and thepayment is due upon your receipt. Payments made after 30 days incur an interest charge of 12% per annum. We welcome candid inquiry concerning our charges and always do our best to complete our work in a minimal amount of time.

If you would like for us to get started I would require that you sign a retainer agreement with us and send a retainer fee. We will also need for you to supply us with copies of all relevant documentation.

I can also provide you with a one-time office based consultation for $250.
