Legal Question in Landlord & Tenant Law in New Jersey

i moved here to indiana 2 months ago but i am still renting an apartment in bemar nj right by the ocean. needless to say my apartment complex is flooded and as of now it is unlivable. Before the storm i sent my november rent check of $1095.00. Hearing the damage after the storm i went to cancel the payment of the check thru my bank. Well instead of cancelling check 2011..cancelled 211. Anyhow on november 5 my landlord cashed my check, i am very angry that he did it since my place is still un liveable. i found out thru another tenant that the whole place is flooded and they have to redue all the electric. so my question is how can i get my rent check back. i did call them several times. they havent return my calls, so i sent them a letter requesting my check, so just want to know my legal rights. thank you

You have habitability issues with the premsis. Your rent should be suspended until the apartment is liveable
