Legal Question in Real Estate Law in New Jersey

injuries from door in a condo.

I hope taht you can help me I am tring to find out information I line in a condo, I had replaced my fromt door I have not yet painted my door do to the fact that I want to paint it white and the condo association wants it dark borwn, I hope that there is some law with the board of health or something, I set due west the front of my condo, if I were to put a thermometer out there it will get pinned to the highest temp. on it. My door gets very hot I have actually leand up against the door last summer prior to the new door and my are stayed red for a while, so I figured that this door is actually a health hazard because if a samll child did it I think that they could have gotten really burned from it, so my questions are if someone got hurt by my door being dark brown which the association wants, who is responsible if the person were to try and sue me? second question, is there a law or something out there that will help me keep my door white since it gets so hot? Would that not be a health and safety hazard? I hope that you can understand what I am asking

Thank you.

Re: injuries from door in a condo.

Please be advised that I have not been retained to represent you and I am basing this response on the limited amount of information supplied. However, condominium associations generally have a great deal of power and the answers to your question lie in the condominium by laws. Usually, exterior paint colors are not the owners choice and usually, the condo association keeps all of the color uniform. However, your by laws could be different and you may a right to paint your door. You will have to look into that. As to you second question, if the exterior of the door is controlled by the condo assocacation, they would bear the burden of any injuries suffered as a result of someone touching the exterior of the door. If you control the exterior, you would bear the burden. Again, look to your bi laws for these answers.

GOOD LUCK
