Legal Question in Real Estate Law in New Jersey

My neighbor has a large dead tree that overhangs my above ground swimming pool. If the tree falls toward my house it would hit the house and if even a big branch just falls off it would smash my pool. What responsibility does my neighbor have to remove the tree before it falls? Do I need to officially notify him of the potential problem?

Not only should you notify him, the two of you should try to cooperate in making sure the tree does not continue to cause a problem. You would have the right to remove the overhanging branches; but it would be better to work with your neighbor in a cooperative fashion. Inviting him over for an afternoon around the pool after the two of you work together to remove the branches might do the trick!
