neighbors septic system found on my property

after some recent excavating near the propety line i found my neighbors active cesspool on my property.what are my liabilities now, and would they change now that i know and do nothing about it.

Assuming that you have given all of the needed information (and no insult, I assure you, it is almost impossible for a person to give ALL of the critical information in a posting like this), then you may want to consider the following ideas.

You must really verify that his cesspool is onto your property before anything else; that takes a licensed professional, a surveyor would be best. If it is on your land, you have to consider what the problems are that you might have because of this. Will his cesspool prevent you from expanding your house? is it too close to your basement or swimming pool? is there some other bad result from this? I would need a lot more information before advising you.
