If a broker from another state misrepresented me by stating he has a licensed in my state and sells my house. I sign a contract to pay him a 5% comm., he did not sign the contract. he wants to sue me for nonpayment, am I liable or not and why?

It depends on what "my state" is. Laws dealing with brokerage and brokerage commissions differ from State to State. Assuming that you are asking about land in New Jersey, the New Jersey law states that no one can bring a suit for a commission on a real property sale unless they are a licensed real estate broker in New Jersey. So, if someone is suing you in New Jersey for a real estate commission, they must be a licensed NJ broker. If not, your attorney can file a motion for dismissal.
