Security Deposit

I've vacated my previous apartment on Aug 16 but couldn't do

a move-out inspection with my ex-landlord because he was out

of town. Two weeks later he called me and said there was a

damage on the ceiling, and I agreed on paying for the cost to

repair it. He promised to send a written estimate prior to a

repair. I waited for two weeks but didn't receive an estimate or

a bill. So I called him up, and he said he's still been waiting for a

written estimate from his contractor but promised to mail a

check for $700 first (out of $1,000 deposit). I doubt that he

would hire someone for such a small damage and cost $300. In

case he keeps my $300 without an actual repair, can I file a

complaint in Small Claims Court? How long should I wait before

taking an action?

The landlord is required to return your security deposit within 30 days or send you written notification advising of the damages under most circumstances. You should consult an attorney for advice on your rights. If you need more info, feel free to call me.
