No. The facts you presented indicate that the personal taking and disclosing the information would, at minimum, be liable for one or more privacy torts, and, depending on the nature of the medical history/condition, the employer may be liable for illegal employment discrimination.

I agree with Barry - more so if they were not just lying around and the person fraudulentlly violated the law to get private records.
