Legal Question in Traffic Law in New Jersey

I am above 21 years and currently hold a NJ GDL learners permit. I was driving with my wife who is a NJ permanent license holder and above 21 yrs as well. I was caught for a speeding violation (39mph in a 25mph zone). I recieved a ticket and my wife was also issued a ticket for GDL violation for allowing me to drive after 11pm. I told the cop that I am aware of the law and that the law does not apply to someone 21 yrs above. But my wife was still issued with a GDL violation ticket.

What should I do in my wife's case? Can I write a letter and get it corrected without appearing in court?

And in my case, what are the consequences? Its my first offence on the GDL permit. Would it affect in anyway in getting a provisional license? Can I downgrade the 2-points to zero by appearing in a court? I was with my 3yr old daughter who was cranky that night and i missed reading the 25mph limit sign coming from a 40mph road.

You can go to Court and explain the situation to the prosecutor, he might agree to dismiss against your wife. You would need to speak to him or her if they could downgrade your ticket to a no point violation, in your case it may be a possibility, good luck
