Legal Question in Traffic Law in New Jersey

I was hit in the rear while stopped at a red light

Hi, I was struck in the rear end while stopped at a red light.

The driver was an employee driving a commercial vehicle.

He was obviously speeding & not paying attention.

I am currently getting tests to see if I have any permanent injuries & am in quite a bit of pain, i am 42 years old & fear that this will be reoccuring for the rest of my life.

what are my limitations to sue?

There are time limitations in that you generally have two years from the date of accident to sue. There may also be limitations if you have selected certain insurance options, however, the fact that the other car was a commercial vehicle, may overcome any such limitation. Some legal analysis would be invovled.

You have a suit. Most attorneys will not charge for a consultation on this type of case. You should chose a few, meet with each and find someone you feel comfortable with. You should get someone to review your case as soon as possible.

You have two years after learning of your injuries to sue for personal injury. If you were ever in an accident prior to this or if you have had similar injuries to the ones for which you are now being treated, your damages could be reduced.
