Legal Question in Traffic Law in New Jersey

''No Insurance'' court summons

I got a ticket today that says ''no insurance.'' I have insurance that was actually effective the day I got the ticket but I didnt have it with me (I never printed it out). I don't have the money for a lawyer, but also don't think one is necessary if I can just bring in my proof of insurance to court. Is this assumption correct? Will I lose my license?

Absent proof of insurance, you will likely lose your license. Call the Court ahead of time and plead "not guilty". Go into Court on the day of Court, show your proofs to the Prosecutor and ask him/her to amend the ticket to 39:3-29 (not having your insurance card in possession). The fine is about $189 and no further suspension or points, rather than one year loss of license and a much larger fine for 39:6B-2, which is what you were charged with.

If the Prosecutor refuses to amend the ticket, ask for a postponement to get a lawyer.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other facts that would change my opinion. And, no one can rely on the opinion of an attorney who has not been retained. Good luck! Rob Gleaner

Mr. Gleaner's advice is dead on. Bring your proof and talk with the prosecutor.

If you are wrong you are going to walk for a year. You need to talk with an attorney about the specifics of your case.
