Legal Question in Traffic Law in New Jersey

Traffic warrant

I had a speeding ticket on 12/10/06 and was given a court date of 12/17/06. I recruited a lawyer on 12/11/06 who said he would plead ''not guilty'' on my behalf and ask for extension of court date. I got a court notice on 12/29/06 sayng that I had neither appeared in court, nor plead, and my new court date was 1/10/07. I called my lawyer, who said there must have been some mix-up at the court, as his office had sent the notice on my behalf, pleading ''not guilty'' and asking for an extension of the court date. I asked him specifically as to what I have to do now. He said his office would take care of EVERYTHING and I have to do NOTHING. I asked him if I should personally plead not guilty. He replied in the negative, again saying that his office would take care of everything. I got a court notice on 2/8/07 saying that a warrant had been issued in my name for contempt of court. What went wrong and what should be my course of action now?

I have read what the other two lawyers wrote. Jef and Gary are great, they have covered the whole topic.

if your lawyer does not explain clearly and simply, what went wrong and that it was NOT his fault, then: fire him, hire another attorney who does a fair amount of traffic tickets in THAT SPECIFIC TOWN MUNICIPAL COURT (4 or 5 cases a year in that court) and get this taken care of. And get your money back from the worthless lawyer.

You should do two things. Demand that the attorney's office immediately fax a letter to the Court explaining the mix up. Secondly, call the Court yourself and explain the mix up.

I would also suggest you find out from the attorney exactly what went wrong. If they did nothing wrong, then you can't blame it on them. If this is because of they neglected to do something, it may be time to get a new attorney.
