Legal Question in Traffic Law in New Jersey
If you get an unsafe Aug 2000 and another unsafe on Sept 2005 and finally another 2020 does that mean the one in 2020 since it is the third offense no matter what is 4 points because of the Patel case?

No. Patel was overturned by the Supreme Court.

Patel is not an issue anymore, if the third unsafe is less than five years after the second, that is where you have an issue, based on your senario, the third is fifteen years later so it would not be an issue, the 97-2 should still be a no point ticket with the $250 surcharge
