Legal Question in Wills and Trusts in New Jersey

712 form from insurance company

I was a beneficiary of a life insurance policy from my father. The executor of his estate keeps asking me to obtain a 712 form from the insurance company that held the policy. My husband is worried that this is some way for them to get at the insurance money we received. What is this form and why would they need it? I live in PA, but my father resided in NJ. Thanks for the help.

A life insurance policy is a contract. If it has a named beneficiary, the insurance is not part of the estate of the deceased, but must be paid by the life insurance company directly to the beneficiary.

Ask the life insurance company what a form "712" is. You should also ask the company, in writing, to pay the proceeds to you.

There may be a reason for the estate to report the existence of the policy, but the proceeds are not part of the estate.
