Grandparents and wills

My husband died at a very young age over 10 years ago. We had 2 kids together. My Father-in-law is deceased, but post-deceased my husband.

My mother-in-law is elderly and not doing well.

I am wondering if my children automatically get their father's share of her estate? OR can she leave it to her 2 remaining chilren (my husband's siblings) and exclude my kids?

First off, she can leave her estate to any recipients she chooses.

If there is no will, then your husband's children will share the intestate portion distributable to their father.

If there is a will, the provisions of the will govern the distribution, and it may or may not provide that his children step into his shoes for distribution purposes
