Legal Question in Wills and Trusts in New Jersey

My mother died 20 months ago, my dad died 7 years prior. Neither of them left a will. They left no money but they did leave a house. I am the youngest (42) of 5 brothers. The problem is that two of my brothers do not want to sell the house. The other two and myself have no interest in keeping the house (we are all homeowners - except for the two that don't want to sell). I told my two brothers that they can keep the house if they want but they need to buy us out. We cannot come to an agreement as to who should be the executor of the estate either. Can there be a force of sale if 3 out of 5 want to sell?? o

yes. and with a house, it costs money every month just to keep it. it should be sold and the money split. if they want to buy it, fine, they must make an offer that you all agree on. if not, it gets sold.

I think you want to move this along. 20 months is far too long to wait. Call me, I have some advice for you on this.
