You do not state why the State took over. This might impact an answer. If the assigned attorney acts improperly, he may have responsibility and his malpractice insurance would be involved. However, if losses are incurred solely due to the economy or the failure of anyone associated with the estate to delay the administration or is not cooperative, no recovery will probably be considered. This is a response to an Internet question and the reply is not intended to be legal advice or as creating an attorney-client relationship. The response could be different if additional facts were presented.
