Legal Question in Consumer Law in New Mexico

being sued for saying ''nigger''

I have a medium-sized restaurant and one of my employees confessed to me that he was in an argument with a patron and called the woman a ''nigger.'' Am I or my business likely to be sued in some way? Thank you.

You never know. All you can do is record that you punished the employee and wait out the statute of limitations on any claims the customer could bring. And make sure it doesn't happen again. Once might be explained but more than that and you need to fire the employee, if you haven't already.

I would try to Identify the customer and take proactive steps to de-fuse the situation before the lawsuit hits and the media gets pulled in. This is the kind of incident that can sink a business quickly.
