Legal Question in Family Law in New Mexico

Child custody/visition

My son and daughter-in-law are seperated, they have one daughter, 3 mos old. My son usually babysits baby monday thru friday while mother works, father works nights so he is available to babysit in the daytime. My son had been picking up the child at 7am and would return the baby to mother at 5 pm. My son did this for 2 weeks and then she got upset on 6/4 and now will not let him see or babysit the child. Her brother has baby today today, 6/6 and called father to see if he would like to see her, but when father went to home he would not answer the door. Can father go and see her there or can he get her and watch her for the remainder of the day. What can he do legally?

Would he be able to take a police office or bernalillo county office with him in order to see his baby?

This is a great question and you are fortunate to live in the Albuquerque metropolitan area. The 2nd Judicial District Court has a pro se clinic where they will help and assist people with the very issue you described in your post. In addition to the pro se clinic KOB TV has a call-in show where you can ask a lawyer your question directly. If you look at the television's web site I believe they have the listings there.

This issue needs resolution at the court and there are plenty of ways to get it before the judge. Good luck.
