Legal Question in Family Law in New Mexico

My ex-husband issued a restraining order aginst my children and I whom I had living with me consistent for the past 4 years with him seeing them off and on since our divorce and has not paid child support for the past 18 months. He owes like 7,500. The restraing order was granted I have not had my children for 2 months and the Commisioner has ordered Supervised visitation. I have been consistently doing visits but I want the Courts to grant me joint custody so kids can be in both homes. Please help with any advice

The Child Support is addressed with a motion for an order to show cause you can find on the First District court web site http://www.firstdistrictcourt.com/Order to Show Cause Forms.htm. You'll have to change the heading to the one for the district you live in.

To change the custody you petition the court for a change of custody and show a change in circumstances.

This sounds like you should have an attorney look at it in detail and develop a strategy. Trying to overcome the effects of the restraining order can be difficult without an attorney who knows the ropes in your court.
