Legal Question in Family Law in New Mexico

I have been separated from my spouse for 20 years now. I have had no contact during those 20 years. He left one day and never heard from him until now he has made contact with our daughter. Am I still legally married to him or is there a statue of limitation on years of separation.

Under NM law you are married until you have become divorced or until your spouse dies. What you should try to find out from him is did he ever file for divorce in all those years you have been separated? I suppose more generally it might be quite helpful for you to determine what exactly he has been doing for the past 20 years. You did not say in which state you got married. There are other laws that could be in play here. I urge you to go and seek an attorney in the town where you live and spend an hour learning about the different laws that could be in play in this situation.

Good luck.
