Confidentiality agreement

if an employee signs a confidentiality agreement but, during a conversation unwittingly tells a spouse information in the privacy of their own home, has s/he breached the agreement?

Technically probably yes; so you would need to limit the potential harm by making sure your spouse doesn't say anything about it...and by that I don't mean a Sopranos hit. You position with the employee is that they will be liable for any damages that result if the spouse leaks the information further.
